MCP API Terms of Service

1. Acceptance of Terms

By accessing or using the Scrapi AI API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

Scrapi AI provides a web scraping API accessible via the Model Context Protocol (MCP). The Service enables AI agents and applications to retrieve publicly available web content, including from websites with anti-bot protection systems.

3. Account & API Keys

  • You must create an account to use the Service.
  • You are responsible for maintaining the confidentiality of your API keys.
  • You must not share, sell, or transfer your API keys to third parties.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately at help@hashscraper.com if you suspect unauthorized use.

4. Acceptable Use

You agree NOT to use the Service to:

  • Scrape personal data (PII) without a lawful basis under applicable privacy laws.
  • Violate any applicable law, regulation, or third-party rights.
  • Interfere with or disrupt target websites beyond normal browsing behavior.
  • Engage in competitive intelligence gathering that violates the Computer Fraud and Abuse Act (CFAA) or equivalent legislation.
  • Distribute malware or engage in any form of cyberattack.
  • Resell or redistribute the Service without written authorization.

You are solely responsible for ensuring your use of scraped data complies with all applicable laws, including the terms of service of target websites.

5. Credits & Billing

  • Credit system: 1 credit = 1 successful page scrape. Failed requests cost zero credits.
  • Subscription credits reset at the beginning of each billing cycle and do not roll over.
  • Purchased credits (credit packs) do not expire.
  • Refund policy: Full refund within 7 days of your first payment. After 7 days, unused subscription credits are not refundable.
  • Payments are processed securely through Polar.sh. We do not store your payment information.

6. Rate Limits & Fair Use

Each plan includes rate limits (requests per minute) and burst limits (concurrent requests). Exceeding these limits will result in HTTP 429 responses. Systematic attempts to circumvent rate limits may result in account suspension.

7. robots.txt Compliance

By default, HashScraper respects robots.txt directives. However, as the Service operator, you may choose to override this behavior for URLs you have authorization to access. You are responsible for ensuring any robots.txt override complies with your legal obligations.

8. Service Availability

We aim for 99.5% uptime but do not guarantee uninterrupted service. We reserve the right to perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by factors beyond our control, including but not limited to target website changes, network outages, or force majeure events.

9. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HASHSCRAPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, REGARDLESS OF THE CAUSE OF ACTION.

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access if you violate these Terms. You may cancel your subscription at any time through the dashboard. Upon termination, your API keys will be immediately revoked.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or dashboard notification at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance.
